प्रतिपक्षीमा बस्न कांग्रेसले प्रस्तुत गरेको २०५१ सालको नजिरमा के छ?
प्रधानमन्त्री पुष्पकमल दाहाल ‘प्रचण्ड’ले गणतान्त्रिक नेपालको संसदीय इतिहासमा नयाँ रेकर्ड कायम गरेका छन्।
प्रतिनिधि सभाबाट विश्वासको मत लिने क्रममा २७५ सदस्यीय प्रतिनिधि सभाका २६८ सांसदले प्रचण्डलाई मत दिएका हुन्। उनको विपक्षमा केवल २ मत मात्र परेको हो।
प्रमुख प्रतिपक्षी दलका रूपमा आफूलाई संसदमा प्रस्तुत गरिरहेको नेपाली कांग्रेसले समेत प्रचण्डलाई विश्वासको मत दिएपछि संसदमा नयाँ रेकर्ड बनेको हो।
यद्यपि प्रधानमन्त्रीलाई विश्वासको मत दिएर पनि कांग्रेसले आफूलाई प्रतिपक्षी दलको रूपमा प्रस्तुत गरेको छ।
नेपाली कांग्रेसले भने यसरी विश्वासको मत दिएको घटना नौलो नभएको भन्दै २०५१ सालको उदाहरण प्रस्तुत गरेको छ।
कांग्रेस उपसभापति समेत रहेका सांसद पूर्णबहादुर खड्काले कांग्रेसले विशिष्ट परिस्थितिमा यो निर्णय लिएको भन्दै २०५१ सालमा पनि तत्कालीन प्रधानमन्त्री मनमोहन अधिकारीलाई विश्वासको मत दिएको र विपक्षमा बसेको उल्लेख गरे। तर कांग्रेसले प्रचण्डलाई मत दिनुको विशिष्ट परिस्थिति के हो भन्ने खुलाएको छैन।
‘तपाईंहरूले विस्तारै थाहा पाउँदै जानुहुन्छ विशिष्ट परिस्थितिबारेमा, मुलुकको जटिलता, आर्थिक अवस्था, संविधानको रक्षा, शान्ति प्रक्रियाको पूर्णता लगायतका विषय विशेष परिस्थितिसँग जोडिएका छन्’, खड्काले भने, ‘संसद प्रतिपक्षीविहीन छैन। २०५१ सालमा पनि मत दिएर हामी प्रतिपक्षमा बसेका हौं। अहिले पनि हाम्रो सिट सुरक्षित छ।’
कांग्रेसले नजिरको रूपमा प्रस्तुत गरेको २०५१ सालको प्रतिनिधि सभामा तत्कालीन प्रधानमन्त्री मनमोहन अधिकारीले प्रतिनिधि सभामा शतप्रतिशत मत प्राप्त गरेका थिए।
अधिकारीलाई राजा वीरेन्द्र वीरविक्रम शाहले २०५१ साल मंसिर १४ गते प्रधानमन्त्री नियुक्त गरेका थिए।
कुनैपनि दलको बहुमत नआएको स्थितिमा सबभन्दा ठूलो दलको हैसियतमा सरकार बनाएका अधिकारीलाई नेपाली कांग्रेस सहितका सबै दलका सांसदले मत दिएका थिए। त्यतिबेला २०५ सदस्यीय प्रतिनिधि सभामा निर्वाचनका बेलामा मतदानमा उपस्थित १९८ सांसदले नै अधिकारीलाई विश्वासको मत दिएका थिए।
२०५१ सालको संसदमा नेकपा एमालेले ८८ सिट, नेपाली कांग्रेसले ८३ सिट, राप्रपाले २० सिट नेपाल सद्भावना पार्टीले ३ सिट र नेपाल मजदुर किसान पार्टीले ४ सिट जितेको थियो। ७ जना स्वतन्त्र सांसद चुनाव जितेर संसदमा आएका थिए। त्यतिबेला मनमोहन अधिकारी, गिरिजाप्रसाद कोइराला र लोकेन्द्रबहादुर चन्द दुई ठाउँमा चुनाव जितेर निर्वाचित भएका थिए।
कांग्रेसले अहिले त्यही २०५१ सालको नजिरलाई देखाउँदै आफूहरूले विश्वासको मत दिने निर्णय गरे पनि प्रतिपक्षी भूमिकामा रहने बताउँदै आएको छ।
तर संसदीय व्यवस्थाका जानकारहरू भने कांग्रेसले विश्वासको मत दिएपछि अब प्रतिपक्षी भन्न नमिल्ने बताउँछन्।
संविधानविद् राधेश्याम अधिकारी प्रतिपक्षीले सरकारलाई समर्थन गर्ने विषय अनौठो मान्छन्।
‘राजनीतिक सिद्धान्तको कुरा गर्ने हो भने प्रतिपक्षी दलले सरकारलाई समर्थन गर्दैन। सरकारलाई समर्थन र विश्वासको मत दिएको दल प्रतिपक्षी हुन्न। तर हामीकहाँ सिद्धान्तभन्दा व्यवहारवादी राजनीति चल्न थाल्यो,’ अधिकारीले भने, ‘संविधान र कानुनमा विपक्षी दलको स्पष्ट परिभाषा छैन। सरकारलाई समर्थन दिए प्रतिपक्षी हुने/नहुने भन्ने कतै उल्लेख छैन। खाली एउटा कानुनमा १० प्रतिशत मत नल्याएको दल प्रमुख प्रतिपक्षी नहुने मात्र भनेको छ। स्पष्ट परिभाषा नभए पनि राजनीति सिद्धान्तमा चल्ने भए यस्तो हुन्नथ्यो।’
कतिपयले भने प्रतिनिधि सभा विपक्षी विहिन भएको टिप्पणी समेत गरेका छन्। उनीहरुले संघीय संसदको पदाधिकारी तथा सदस्यहरुको पारिश्रमिक तथा सेवा र सुविधा सम्बन्धि ऐनलाई आाधारका रुपमा प्रस्तुत गरेका छन्।
उक्त ऐनले प्रतिपक्षी दलको नेताको ब्याख्या गरेको छ। जसमा ‘मन्त्रिपरिषद् गठन गर्ने वा मन्त्रिपरिषद् गठन गर्न समर्थन गर्ने दल बाहेक प्रतिनिधि सभा वा राष्ट्रिय सभामा दश प्रतिशत वा सो भन्दा बढी सदस्य भएको दल हुनुपर्ने’ प्रावधानलाई देखाएका छन्।
उक्त प्रावधान अनुसार अहिलेको प्रतिनिधि सभामा प्रधानमन्त्रीलाई विश्वासको मत नदिएका कुनैपनि दलको दश प्रतिशत संख्या छैन। यस्तोमा प्रतिनिधि सभाका अध्यक्ष वा राष्ट्रिय सभाका अध्यक्षले तोकिदिएको कुनैपनि दल प्रमुख प्रतिपक्षी दल हुनसक्छ।
