निर्वाचन आयोगको जरिवाना तिराउने निर्णयविरूद्ध सर्वोच्च पुगे मेयर बालेन
काठमाडौं महानगरपालिकाका मेयर बालेन शाहले निर्वाचन आयोगले तोकेको जरिवानाविरूद्ध सर्वोच्च अदालत पुगेका छन्।
मंगलबार मेयर शाहले सर्वोच्च अदालतको संवैधानिक इजलासमा निवेदन पेश गरेका हुन्।
निर्वाचन आयोगले मेयर शाह लगायतलाई चुनावी खर्च ढिलो गरी बुझाएको भन्दै जरिवाना तोकेको थियो।
आयोगले उनलाई ७ लाख ५० हजार जरिवाना तोकेको थियो। यस्तै ७ लाख ५० हजार रुपैयाँ चुनावी खर्च गर्न पाउने भए पनि आफूले ३ लाख ९४ हजार ४८९ रुपैयाँ मात्रै खर्च भएको विवरण शाहले बुझाएको बताएका छन्।
आयोगले खर्च विवरण नबुझाउने र समयमा नबुझाउने उनीसहित थुप्रै उम्मेदवारहरूलाई जरिवाना गरेको थियो। आफू लगायत आयोगको निर्णयले अन्याय भएको भन्दै उनले निवेदन दिएका हुन्।
‘आयोगको कानूनको उचित प्रक्रिया विपरितको एउटै गोश्वारा निर्णयबाट म निवेदक लगायत मैले प्रतिनिधित्व गर्ने संस्था काठमाडौं महानगरपालिका तथा अन्य स्थानीय तहको निर्वाचनमा उमेदवार बनेका जम्मा १,२३,६२४ जना व्यक्तिलाई जरिवाना लागेको, पटक पटक अनुरोध गर्दा पनि आयोगले आफ्नो निर्णयमा पुनर्विचार गरेको छैन,’ शाहले सर्वोच्चमा हालेको निवेदनमा उल्लेख छ।
निर्वाचन आयोगबाट जरिवाना हुने निर्णयहरू बदर गर्न उनले माग गरेका छन्।
‘आयोगबाट भएका काम कारवाही, म्यादभित्रै खर्च विवरण बुझाएको तथ्यलाई समेत अनदेखा गरी ७ लाख ५० हजार जरिवाना तिर्न लगाउने लगायत निर्णय, त्यस्तो जरिवाना रकम जनही रुपमा ६ महिना भित्र (अर्थात् २०७९ फागुन मसान्त सम्म) नबुझाएमा ६ वर्ष सम्म कुनै पनि निर्वाचनमा भाग लिन रोक लगाउने गरी भएको निर्णय तथा निर्वाचित व्यक्ति भए निज स्वतः पदमुक्त हुने सम्बन्धी काम कारवाही, सो सम्बन्धी भए गरेका वा हुने अन्य सम्पूर्ण काम कारवाही प्रतिषेधयुक्त उत्प्रेषणको आदेशले बदर गरी पाऊँ,’ पत्रमा उल्लेख छ।
निर्वाचन सकिएको मितिबाट ३० दिनभित्र खर्च विवरण बुझाउनुपर्ने व्यवस्था छ। असार ११ गते शनिबारको दिनसम्म निर्वाचन खर्च विवरण बुझाउनुपर्ने समय तोकेको थियो।
तर शाहले शनिबार सार्वजनिक बिदा परेको हुँदा भोलिपल्ट मात्रै अर्थात असार १२ गते विवरण पेश गरेका थिए। चुनावको बेला आयोग सार्वजनिक बिदामा पनि खुला नै थियो।
यस्तै मेयर बालेनले निर्वाचन ऐन २०७३ को दफा २६ (३) र दफा २६ (५) को व्यवस्था संविधानसँग बाझिएको उल्लेख गरेका छन्।
शाहले अदालतबाट तत्काल आवश्यक र उपयुक्त अन्तरिक आदेश जारी गर्न पनि माग गरेका छन्।
